Welcome to Sehat Digital (the "Platform"). By registering for, accessing, or using our mobile application, website, or services, you ("User," "Patient," or "you") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must immediately cease using the Platform.
1.1 No Emergency Services. THE PLATFORM IS NOT TO BE USED FOR MEDICAL EMERGENCIES. If you are experiencing a life-threatening medical emergency (including, but not limited to, severe chest pain, stroke symptoms, difficulty breathing, major physical trauma, or severe poisoning), you must immediately call your local emergency services (e.g., 1122 or 15) or go to the nearest physical hospital emergency room.
1.2 Intermediary Role. The Platform is an online intermediary that facilitates connection between independent, licensed healthcare professionals ("Providers") and registered users. While we verify the professional credentials of Providers, we do not practice medicine or provide medical advice directly. Any professional relationship established during a teleconsultation is strictly between the patient and the Provider.
2.1 Age and Representation. To create an account and use the Platform, you must be at least 18 years of age and possess the legal capacity to enter into a binding contract. If you are under 18, a parent or legal guardian must register on your behalf and supervise all virtual consultations.
2.2 Accuracy of Information. You agree to provide true, accurate, current, and complete information during registration and in your medical profile. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3.1 Technological Limitations. By using our telemedicine services, you acknowledge and accept the inherent limitations of remote consultations, including:
3.2 Right to Refuse Telehealth Care. If a Provider determines that your medical needs cannot be safely met through a virtual consultation, they reserve the right to advise you to seek in-person medical care or refer you to a physical healthcare facility.
4.1 Professional Autonomy. Providers retain absolute professional autonomy. Consultation does not guarantee that a prescription or laboratory referral will be issued.
4.2 Prohibited Medications (Controlled Substances). Providers using our Platform strictly cannot prescribe narcotics, highly addictive substances, psychiatric stimulants, experimental medications, or other heavily controlled substances.
4.3 Validity of E-Prescriptions. Electronic prescriptions (e-prescriptions) generated through the Platform are subject to local pharmacy regulations and are only valid for the specific individual named.
5.1 Consultation Fees. Consultation fees are displayed on the Platform prior to booking. By scheduling an appointment, you agree to pay the designated fee via our integrated payment gateways.
5.2 Cancellation and Rescheduling Policy.
5.3 Payment Failures. We utilize secure, third-party payment processors. We are not liable for transaction failures, double-billing errors, or banking security breaches attributable to third-party institutions.
You agree not to engage in any of the following activities:
7.1 Limitation of Liability. To the maximum extent permitted by applicable law, neither Sehat Digital nor its directors, employees, or affiliates shall be liable for any indirect, incidental, special, exemplary, or consequential damages arising out of:
7.2 Indemnification. You agree to indemnify, defend, and hold harmless the Platform, its parent company, and its affiliates from any claims, losses, liabilities, damages, or costs (including legal fees) arising from your breach of these Terms, misuse of the Platform, or violation of any third-party rights.
8.1 Governing Law. These Terms shall be governed by, construed, and enforced in accordance with the laws of Pakistan, without regard to its conflict of law principles.
8.2 Informal Dispute Resolution. Before initiating formal legal action, you agree to contact us at drimtisal@gmail.com to attempt to resolve any dispute or claim through friendly, informal negotiations.
8.3 Arbitration. Any unresolved dispute arising out of or in connection with these Terms shall be referred to and finally resolved by binding arbitration in Lahore, in accordance with local arbitration laws.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. Your continued use of the Platform after the effective date constitutes acceptance of the modified Terms.
